PatronArt.com website (“Site”) is owned and operated by PatronArt LLC (“Company”). You agree to follow and be bound by this privacy policy statement (“Privacy Policy”) and to enter into agreement with Company. In these Terms of Use, the words “you” and “your” refer to each Site visitor or user, “we”, “us” and “our” refer to PatronArt.com and PatronArt LLC, and “Services” refers to all services provided by Company. This Privacy Policy is incorporated into the Terms of Use. The Company and Site will collect, use, and disclose your personal information as described in this Privacy Policy. For you to access certain services that we offer through the Site, we may require you to provide us with information that can identify you as an individual (“Personally Identifiable Information” or “PII”).   1. How Information is Used

We may use your PII to to contact a Customer [Patron] or Artist regarding an order between Customer and Artist or a commissioned piece between Customer and Order or to respond to a question or request or disciplinary matter. Any Financial Data gathered is used for the purposes of processing or completing the financial transaction for purchase and/or commissions between Customer and Artist.

Please note that PII and anonymous data is used to gather general statistics regarding our customers and visitors, in order to enhance the consumer experience on the Site. We may also use demographic data in a manner that does not identify you specifically or allow you to be contacted but does identify certain criteria about our users in general. For example, we may inform third parties about the number of registered users, number of unique visitors, and the pages most frequently browsed.

If you post information on any of our chat groups, message boards or forums, such information you provide may be available to other members of the Site and other Site visitors. You should use caution when deciding to disclose your personal information in these venues as we do not control who may participate on these interactive platforms nor do we control who may see your personal information on these interactive platforms.

Also, please be advised that certain personal information becomes public record upon the filing of documents with the state, the court, government agencies (e.g. United States Patent and Trademark Office, United States Copyright Office). This Privacy Policy does not cover actions by these third parties or any other third party that becomes privy to your personal information by way other than provided by Company or Site.

You may choose not to provide us with any PII. In such an event, you can still access some portions of the Site that do not require PII. However, you will be unable to access and use portions of the Site that require your PII.

Except as described in this Privacy Policy, we will not share your PII with third parties, unless such disclosure is necessary. Such disclosure may become necessary as determined in our sole discretion, to protect Company’s rights or property, for the safety of a third party whether or not third party is a Customer or Artist, to enforce the Terms of Use, or as obligated by law or court order. To the extent such disclosure is required by law or court order, where practical and allowable, Company will inform you of the requirement to disclose PII before or after such disclosure.

Company uses reasonable measures to maintain the security of your PII. However, no company, organization, or online community, including the Site and the Company, can fully eliminate security risks associated with personal information.

  1. Other Disclosures

We may provide your PII to third party service providers who work on behalf of or with Company to provide some of the services and features of the Site and to help Company communicate with Customers or Artists. However, these service providers do not have any independent right to share this information and are subject to the same or similar requirements of the Company to protect PII.

Company may share some or all of your personal information with our subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy.

If the assets related to the Site are acquired by another company, that company will possess the personal information collected by us and it will assume the rights and obligations regarding your PII as described in this Privacy Policy.

The Site has security measures in place to minimize the loss, misuse, destruction and alteration of the information that you provide us or that we obtain from you. Company and Site will have no liability however to you or to any third-party arising out of any such loss, misuse, destruction, or alternation.

  1. Other Limits to Your Privacy

The Site contains links to other third-party websites (“Linked Websites”). Company is not responsible for the privacy practices or the content of the Linked Websites. If you choose to visit other websites, we are not responsible for the Privacy Practices or content of those other websites, and it is your responsibility to review the privacy policies and terms of use at those websites to confirm that you understand and agree with their policies.

As aforementioned, Company may also make chat groups, forums, and message boards available to you, but please understand that any information you disclose in these areas becomes public information and accordingly, such information is not subject to this Privacy Policy. We have no control over its use and you should exercise caution when deciding to disclose any personal information.

Company reserves the right, at any time and without notice, to add to, change, update or modify this Privacy Policy, by posting such change, update or modification on the Site. Any such change, update or modification will be made in writing to this Privacy Policy and shall be posted on the Site and shall be effective immediately upon posting.
